Annexure I

1. Price: The hire rate agreed is payable monthly for operation of the equipment on hire on the basis of 8 hrs per day, 6 days a week and 25 days in a calender month. (Total of 200 hrs / month ). Minimum 200 hours will be charged per month even if the machine is kept idle. Any usage of machine beyond this shall be charged extra on pro-rata basis.

2. Crew: The hire rate includes charges of Operators/ Service Engineers for operation of the hired equipment including maintenance and technical support for the same. However a suitable accommodation & Food shall be provided by you at the site at your cost.

3. Fuel: The hire rates are without fuel. Fuel to be provided by you at the site. Any down time due to non-availability of fuel shall be to your account. You shall ensure the quality of the fuel. Any breakdown / damages to the equipment due to bad quality of fuel shall be to your account.

4. Lubricants, Oils, Filters & other consumables & maintenance: Hydraulic oil, grease, Hydraulic Hoses, all Filters and Rubber Components will be to your account.

5. Mobilisation and Demobilisation: Both ways transportation i.e. from our Yard at Navi Mumbai or from the site where the machine is currently located to your site and back to Navi Mumbai Yard at actual is to re-imbursed to us against submission of transporter’s bill within 7 days.

Mobilisation of the equipment/machine shall be effected by us only after realisation of the mobilisation advance.

6. Maintenance : The machine shall be maintained by us to ensure an uptime of approx. 80% during the period of hire. We shall carry out routine, operational maintenance at site with prior intimation to your site personnel. The machine should be made available for this regular maintenance of atleast 2 days per month

7. Unloading and Loading at site: Shall be your responsibility at your cost.

8. Safety, Parking and Storage: You will ensure the safe keeping of machine, accessories & spares. You shall provide suitable space for parking, storage & safekeeping of the equipment on hire, at your cost. Any damage and/ or any misuse will be to your account.

9. Border Clearance : Entry Tax/ Road Permit and related expenses (if any) of the machine at State Border , shall be your responsibility.

10. Duties and Taxes: All taxes & duties applicable to this contract shall be to your account. Octroi, Entry Tax, Sales Tax, VAT, Works Contract Tax, any other govt. levies, if any shall be borne by you.

11. Payment: 1 months rentals is payable in advance alongwith the work order. Subsequent Rental Payments should be made in advance before the commencement of the next month by Cheque/DD payable at Mumbai drawn in favour of AURTECH GLOBAL. Payment for hire charges, would be made within 7 days of submission of invoice. Delayed payments shall be subject to 18% interest p.a.

12. Insurance: Our equipment is insured by us.

13. Force Majeur Clause : If the machine deployment gets delayed due to forces of nature and reasons beyond our control, no penalty shall be charged.

14. Extension of the contract: You Must inform us in writing atleast 30 days in advance your intention to extend the contract. After the expiry of the rental period if the machine is held back at your site forcibly or otherwise, you will be charged at 4 times the actual charges.

15.Ownership of the machine : The possession of the machine shall will remain with us at all times during the contract. Our operators and engineers shall only be operating & maintaining the machine. We reserve our right to stop the machine anytime in case the Rental payments are overdue for more than 7 days from submission of the bills. Our Operator / Service Engineer and all our authorized personnel have the right to enter your site to inspect, operate or possess the machine.

16. Validity : This offer is valid upto 30 days.

17. Any dispute arising out of this contract is subject to Arbitration & Conciliation Act, 1996.
